Philip R. Erwin

Mr. Erwin is a Partner of Campbell & Williams and has been a member of the Firm since 2009. Mr. Erwin’s practice focuses on complex commercial disputes involving litigation over claims for breach of contract, breach of fiduciary duty, fraud and fraudulent transfers, and numerous other issues. Mr. Erwin has likewise litigated catastrophic personal injury and wrongful death cases. With a focus on sophisticated legal strategy and detailed preparation to account for any variable in litigation, Mr. Erwin has drafted countless legal briefs (including obtaining multiple seven-figure judgments and numerous dismissals by way of summary judgment), taken and defended depositions, handled a variety of motion and evidentiary hearings, and conducted various trials, arbitrations and appellate proceedings. Mr. Erwin has also appeared as an expert witness on the subject of Nevada contract law in foreign proceedings involving the sport of professional boxing.

Mr. Erwin is an “AV Preeminent” rated lawyer by Martindale-Hubbell and has been recognized by Super Lawyers on an annual basis since 2013. Mr. Erwin has also been recognized by Best Lawyers and Chambers in the area of commercial litigation. Mr. Erwin takes pride in his work at the appellate level and has obtained several notable decisions on behalf of his clients:

• The Power Co., Inc. v. Henry, 130 Nev. 182, 321 P.3d 858 (2014) (affirming entry of $9 million judgment and establishing new legal precedent regarding the application of NRCP 41)

• Henry v. Rizzolo, 554 Fed.Appx. 671 (9th Cir. 2014) (affirming entry of summary judgment on fraudulent transfer claims and unwinding multimillion dollar transactions designed to thwart collection of a $10 million judgment)

• Gardner of Behalf of L.G. v. Eighth Judicial Dist. Court, 133 Nev. 730, 405 P.3d 651 (2017) (finding that limited liability company members can be sued individually for personally participating in tortious acts and that alter ego doctrine applies to limited liability companies)

• Gardner v. R&O Constr. Co., 443 P.3d 549 (Nev. June 26, 2019) (finding that reverse veil-piercing claim may be pleaded prior to entry of judgment and that such a claim is not barred by the lack of stock ownership)

• Las Vegas Metro. Police Dep’t v. The Center for Investigative Reporting, Inc., 136 Nev. 122, 460 P.3d 952 (2020) (deciding as a matter of first impression that the requester of LVMPD’s investigatory file concerning the murder of Tupac Shakur was entitled to attorney’s fees under Nevada’s Public Records Act pursuant to “catalyst theory”)

• Cohen v. Padda, 138 Nev. 149, 507 P.3d 187 (2022) (deciding as a matter of first impression that attorney was entitled to legal fees for work she completed prior to suspension and unrelated to suspension)

• Rasier, LLC v. Boykin, 534 P.3d 153 (Nev. Aug. 24, 2023) (rejecting illegality challenge to arbitration agreement and enforcing delegation clause in publicly traded corporation’s customer contract)

Mr. Erwin’s recent work at the district court level includes:

• Drafted and prevailed on multiple motions for summary judgment that were argued over the course of several days before resolving breach of contract claims brought against a global gaming company in advance of trial

• After a multi-week arbitration in the Bay Area, obtained favorable monetary judgment and attorney fee award for affiliate of publicly traded Las Vegas casino operator and complete defense of multi-million-dollar counterclaim

• Successfully obtained the dismissal of claims for breach of a joint venture agreement, fraud and breach of fiduciary duty in a matter involving a large commercial brokerage in which the plaintiffs sought over $3 million in damages

• Drafted all legal briefs at the district court and appellate court level in election contest in which Governor Lombardo preserved the results of the 2022 Republican Primary against claims of election fraud

• Successfully moved to dismiss claims for legal malpractice, bankruptcy fraud and RICO brought against law firm and individual lawyers on grounds the claims arose from a de facto assignment in violation of Nevada’s public policy

• Drafted all legal briefs at the district court and appellate court level and part of trial team in a matter that resulted in a $49 million judgment against a water park on behalf of a catastrophically injured minor

Mr. Erwin grew up in Reno, Nevada and attended the University of Nevada, Reno before receiving his Juris Doctorate with cum laude honors from the William S. Boyd School of Law at the University of Nevada, Las Vegas. Outside of the office, Mr. Erwin enjoys spending time with his wife, coaching his son’s soccer team, watching his daughter’s dance competitions, and being outdoors in the mountains of Montana.
